2018 Housing Element and Fair Share Plan (Phillips)

Housing Element and Fair Share Plan adopted by Millburn which allowed for temporary immunity via a Declaratory Judgement Action in the Superior Court. This plan was compiled by Paul Phillips, our town planner of 15+ years.

2021 Fair Share Housing Settlement Agreement

This document includes all of Millburn’s obligations as it relates to the fair share housing settlement that the Township Committee authorized in July 2021. It includes all of the new developments, 9 Main St 100% very-low, low, and moderate income development, and details related to all of the overlay zoning densities.

2022 Fair Share Housing Element and Fair Share Plan (McManus)

Housing Element and Fair Share Plan proposed by Beth McManus. This proposed plan would update the Master Plan of the town to incorporate the components of the fair share housing settlement agreement. On June 15, 2022, the Planning Board voted not to accept this plan. However, the Planning Board will reconvene on July 20, 2022 to take a re-vote.

Zoning Ordinance 2604-22

The ordinance introduced that implements the OR-1 zoning change of the 2021 fair share housing settlement agreement, increasing residential density of the complex across from the Mall at Short Hills to 25 dwelling units per acre.  This ordinance was introduced after a 3-2 vote (Miggins, Wasserman, Vinayak for; Prupis and Thall-Eglow against) on June 21, 2022.  The second hearing, which will allow for public comment, is scheduled for July 19, 2022.

Zoning Ordinance 2605-22

The ordinance introduced that implements the CMO zoning change of the 2021 fair share housing settlement agreement, increasing residential density of the area south and east of the Millburn ShopRite to 18 dwelling units per acre.   This ordinance was introduced after a 3-2 vote (Miggins, Wasserman, Vinayak for; Prupis and Thall-Eglow against) on June 21, 2022.  The second hearing, which will allow for public comment, is scheduled for July 19, 2022.

Zoning Ordinance 2606-22

The ordinance introduced that implements the B-2 zoning changes of the 2021 fair share housing settlement agreement, increasing residential density of the area from the old Annie Sez building to Myrtle Ave, between Millburn Ave and the train tracks to 40 dwelling units per acre; and the area of Short Hills adjacent to Morris Turnpike to 18 dwelling units per acre. This ordinance was introduced after a 3-2 vote (Miggins, Wasserman, Vinayak for; Prupis and Thall-Eglow against) on June 21, 2022.  The second hearing, which will allow for public comment, is scheduled for July 19, 2022.

Zoning Ordinance 2607-22

The ordinance introduced that implements the B-4 zoning changes of the 2021 fair share housing settlement agreement, increasing residential density in the downtown core of the Township to 25 dwelling units per acre. This ordinance was introduced after a 3-2 vote (Miggins, Wasserman, Vinayak for; Prupis and Thall-Eglow against) on June 21, 2022.  The second hearing, which will allow for public comment, is scheduled for July 19, 2022.

Zoning Ordinance 2608-22

The ordinance that implements the zoning changes for Canoe Brook Country Club in the 2021 fair share housing settlement agreement, increasing residential density to 8 dwelling units per acre. This ordinance was not introduced following a 2-2 vote (Wasserman, Vinayak for; Prupis and Thall-Eglow against; Miggins recused) on June 21, 2022.

DPW Site Investigation (environmental) report

This is the environmental report for the site of the proposed 9 Main St 100% income-segregated 75-unit housing project. On pages 14 and 28 of the PDF, you can see excessive concentrations of antimony, arsenic, beryllium, lead, mercury, and benzo(a)pyrene.
